Верховна Рада в другому читанні ухвалила законопроєкт №3450, який передбачає створення Єдиного порталу повідомлень викривачів корупції. З ним можуть працювати як викривачі, так і уповноважені суб’єкти щодо запобігання корупції в різних органах.
Таке рішення 4 лютого підтримали 253 народні депутати.
Так, законопроєкт ухвалили для «створення правової основи для здійснення повідомлень викривачів через Єдиний портал повідомлень для належного та якісного впорядкування процедури розгляду повідомлень про корупцію».
Документ передбачає, що повідомлення від викривачів підлягатиме розгляду, якщо наведена в ньому інформація містить дані, що підтверджують корупційний злочин. Повідомити про факт корупції можна й анонімно.
Згідно з документом, якщо викривач претендуватиме на винагороду, то її виплачуватимуть не після рішення суду, а після реального стягнення коштів із корупціонера в дохід держави.
Рішення про початок роботи Єдиного порталу повідомлень викривачів ухвалює Національне агентство з питань запобігання корупції.
Нагадаємо, у жовтні 2019 року Верховна Рада ухвалила закон про грошову винагороду викривачам корупції. Він передбачає, що викривачі можуть претендувати на грошову винагороду за повідомлення про корупцію. Однак лише в тому разі, якщо розмір хабаря або збитків, завданих державі від факту корупції, становить не менш як 5 000 прожиткових мінімумів (майже 11 мільйонів гривень).
Винагорода може становити до 10% від суми відшкодованих збитків або розміру неправомірної вигоди, але не може перевищувати розмір 3 000 мінімальних заробітних плат (18 мільйонів гривень). Рішення про винагороду викривачу ухвалює суд.
Крім того, викривачам гарантують безкоштовну правову допомогу: захист у разі загрози життю чи здоровʼю та відшкодування витрат на адвоката.
