Поліція, як і в переважній більшості випадків перешкоджань журналістам, не побачила в діянні ознак складу кримінального правопорушення, передбаченого ч.1 ст.171 КК України.
Повідомлення про закриття кримінального провадження журналістка “Чернівці.Онлайн” Галина Єреміца отримала у Чернівецькому міському відділі поліції наручно увечері, 19 листопада 2018 року.
«На підставі ч.5 ст. 284 КПК України повідомляю Вам, що досудове розслідування, внесене до ЄРДР за № 12018260020001222 від 04.10.2018 року завершено та прийнято рішення про закриття кримінального провадження у зв’язку з встановленням відсутності в діянні складу кримінального правопорушення, передбаченого ч.1 ст.171 КК України, на підставі п.2 ч.1 ст. 284 КПК України.
Постанова про закриття кримінального провадження може бути оскаржена відповідно до ст. ст. 303, 304 КПК України, слідчому судді протягом десяти днів з дня отримання її копії.Додаток: постанова про закриття кримінального провадження на 2 арк.», – йдеться у повідомленні.
Нагадаємо, 3 жовтня 2018 року журналістці “Чернівці.Онлайн” Галині Єреміці заборонили вести відеозйомку зустрічі жителів Великокучурівської ОТГ щодо проблем електропостачання у громаді з керівництвом АТ «Чернівціобленерго».
Відтак, журналістка викликала поліцію і написала заяву про перешкоджання професійній журналістській діяльності.
Під час прийому громадян керівник підприємства-монополіста Сергій Таранюк категорично заборонив журналістці проводити відеозйомку цієї публічної зустрічі публічних осіб з жителями громади, хоча інформація, яка мала обговорюватись на зустрічі, становила суспільний інтерес.
«Посадова особа, керівник підприємства-монополіста, на робочому місці не мала права перешкоджати журналістці відезйомку даної зустрічі, бо це суспільно значима інформація», – роз’яснив медіа-юрист Олександр Тарасов, коментуючи дану ситуацію.
За даними Інституту Масової Інформації (ІМІ), від початку 2018 року у Чернівецькій області зафіксовано 4 випадки порушення прав журналістів (перешкоджання професійній діяльності).
