Колегія суддів Чернівецького апеляційного суду скасувала вирок 33-річного чернівчанина, обвинуваченого у незаконному придбанні, зберіганні і збуті наркотичних засобів. Вироком Шевченківського районного суду чоловік був засуджений до 4 років позбавлення волі. Адвокат та прокурор оскаржили рішення суду, про це повідомила пресслужба Чернівецького апеляційного суду.
Захисник обвинуваченого вважав, що вина його підзахисного не доведена, в той час як державний обвинувач посилався на призначення занадто м’якого покарання. Дослідивши матеріали справи, колегія суддів не знайшла переконливих та достовірних доказів його винуватості у вчиненні злочинів, а сторона обвинувачення не надала обґрунтованих свідчень на спростування цього.
Також було встановлено, що при проведенні слідчих дій були допущені суттєві порушення процесуального законодавства, у зв’язку з чим отримані докази не могли слугувати підставою для обвинувачення. Апеляційний суд скасував вирок суду першої інстанції, а кримінальне провадження закрив за невстановленням достатніх доказів для доведення винуватості особи в суді і вичерпанням можливості їх отримання.
