У Державній митній службі спільно з Міністерством юстицій працюють над текстом законопроєкту щодо криміналізації контрабанди.
Про це в інтерв’ю DT.UA сказав голова Державної митної служби Максим Нефьодов.
“Ми прихильники криміналізації контрабанди, і це підтримує ЄС. Наразі спілкуємося з Мін’юстом, який вважає, що треба коректно виписати текст, бо адміністративне провадження проходить значно швидше, ніж кримінальне. Кримінальне провадження дійсно йде роками. Там зовсім інші стандарти доведення. Тому є позиція, що в наших специфічних реаліях з нашими специфічними судами зміни можуть призвести до того, що на папері все виглядатиме жорсткіше (посадити, конфіскувати…), але в реальності отримаємо гірші результати”, – сказав Нефьодов.
За його словами, кримінальна відповідальність має застосовуватись до достатньо високого порогу контрабанди.
“Якщо, приміром, Range Rover везе 1600 пачок сигарет, то треба конфіскувати, оштрафувати, забрати Range Rover і на цьому зупинитися. А не засуджувати людину на п’ять років умовного терміну. Тільки в разі, якщо везуть комерційну партію, приміром на мільйон доларів, отут уже має бути кримінальне покарання. Ми вже підготували по криміналізації один законопроєкт. Отримали зауваження і зараз працюємо з ЄС, щоб підготувати другу ітерацію законопроєкту. Наскільки мені відомо, Офіс Президента підтримує таку позицію”, – зауважив Нефьодов.
