Державне бюро розслідувань скерувало до Генпрокуратури проєкт повідомлення про підозру п’ятому президенту України та чинному нардепу Петрові Порошенку.
Як мовиться у повідомленні пресслужби ДБР, проєкт підозри підготовлено та направлено до прокуратури у межах досудового розслідування кримінального провадження. Стосується воно можливого неправомірного впливу на проведення конкурсу з добору кандидатів для призначення членів Вищої ради правосуддя. Відбувся цей конкурс у березні-травні 2019 року.
Зауважимо, що Порошенка підозрюють у:
- Вчиненні кримінальних правопорушень, передбачених частиною 3 статті 109 Кримінального кодексу. Мовиться про дії, спрямовані на насильницьку зміну чи повалення конституційного ладу або на захоплення державної влади з боку представника влади. Ця стаття передбачає обмеження волі на строк до п’яти років або позбавленням волі на той самий термін.
- Вчиненні Кримінальних правопорушень, передбачених частиною 2 статті 364 Кримінального кодексу. Мовиться про зловживання владою або службовим становищем, що спричинило тяжкі наслідки. Ця стаття передбачає позбавленням волі на строк від трьох до шести років з позбавленням права обіймати певні посади чи займатися певною діяльністю терміном до трьох років, а також штраф у розмірі від п’ятисот до однієї тисячі неоподатковуваних мінімумів доходів громадян, тобто від 480 тисяч гривень до 960 тисяч гривень.
Також слідчі ДБР направили до прокуратури проєкт подання до Верховної Ради щодо надання згоди на притягнення Порошенка до кримінальної відповідальності, оскільки той є чинним народним депутатом України.
