Під час судового розгляду встановили та довели, що 7 листопада 2018 року чернівчанин, на ґрунті тривалих неприязних відносин із своїм 69-річним батьком, під час чергового конфлікту побив та задушив старенького.
Шевченківський районний суд м. Чернівці погодився з доводами прокурора та визнав винним обвинуваченого в умисному вбивстві. Про це повідомляє пресслужба прокуратури Чернівецької області.
Разом з тим, при призначенні 45-річному чоловіку покарання колегія суддів застосувала вимоги ст. 69 Кримінального кодексу України та призначено покарання нижче від найнижчої межі, передбаченої санкцією ч.1 ст.115 Кримінального кодексу України, а саме у вигляді 5 років позбавлення волі.
Вирок ще не набрав законної сили.
Прокуратура вивчає можливість оскаржити його в апеляційному порядку, в частині застосування ст. 69 (призначення більш м’якого покарання, ніж передбачено законом) Кримінального кодексу України.
