Керівник Чернівецької місцевої прокуратури звернувся до Господарського суду Чернівецької області з позовом в інтересах держави до Чернівецької міської ради та обслуговуючого житлово-будівельного кооперативу про визнання незаконним та скасування рішення сесії Чернівецької міської ради, скасування рішення про державну реєстрацію права власності та повернення земельної ділянки вартістю 2,5 млн грн.
Встановлено, що у жовтні 2018 року рішенням сесії Чернівецької міської ради затверджено проект землеустрою та передано безоплатно у власність обслуговуючому житлово-будівельному кооперативу земельну ділянку площею 0,3419 га у м. Чернівці для будівництва та обслуговування багатоквартирного житлового будинку.
Зокрема, всупереч вимогам ст.41 Земельного кодексу України, ст.ст.133-135, 137 Житлового кодексу УРСР та Примірного статуту житлово-будівельного кооперативу, засновниками обслуговуючого житлово-будівельного кооперативу виступили лише троє осіб (при мінімальній необхідній кількості – 5), які не перебували на квартирному обліку осіб, які потребують поліпшення житлових умов, та були забезпечені власним житлом, а тому не мали права на безоплатне отримання земельної ділянки комунальної власності.
Крім того, не дивлячись на вимоги Примірного статуту, яким передбачено, що число громадян, які вступають до організовуваного кооперативу, повинно відповідати кількості квартир запланованому до будівництва у жилому будинку або будинках кооперативу, на отриманій земельній ділянці заплановано будівництво п’яти блоків житлових будинків із загальною кількістю квартир – 171 для 3 членів ОЖБК.
